1. WELCOME.

These AngeLink, Inc. (“AngeLink”) Terms of Service (“Terms of Service”), constitute a legal, binding contract and apply to your access to and use of the AngeLink platform, including the website located at www.angelink.com and mobile applications (the “AngeLink Platform” or “Platform”). AngeLink reserves the right, at our sole and exclusive discretion, to update and/or amend these Terms of Service. When these Terms of Service are updated and/or amended, the above date of the Terms of Service are updated and we will send you an email notifying you of the updates. Your continued access to or use of the AngeLink Platform constitutes your acceptance to any updated Terms of Service. If for any reason you do not agree to or accept the updated Terms of Service, you must discontinue your access to and use of the AngeLink Platform and exit immediately.

The Platform is for individuals, groups, entities, Charities, and non-profit organizations (“Campaign Organizers”) to raise money (“Donations”) from individual donors (each, a “Donor”) for the benefit of an individual, group, entity, Charity, or other non-profit organization (each, a “Beneficiary”) for a specific purpose (each, a “Campaign”). A “Charity” is a non-profit, tax-exempt organization recognized by the United States Internal Revenue Service as a 501(c)(3) or (c)(4) charitable organization. Campaign Organizers, Donors, Beneficiaries, and anyone who accesses or uses the Platform are referred to in these Terms of Service individually and collectively as a “User” or “Users”. For purposes of these Terms of Service, “User” and “Users” may be referred to as “you”, “your” and/or “yours”. “AngeLink” may be referred to as “us”, “we”, and/or “our” and shall mean and include AngeLink and its subsidiaries and affiliates, and its and their investors, officers, directors, employees, agents, representatives and assigns.

The Platform enables Campaign Organizers to raise money by connecting with Donors and processing Donations. The Platform does not represent a solicitation of Donations by AngeLink, and we do not engage in solicitation activities or consult on the solicitation of Donations for any individual or organization. By using the Platform, you understand and expressly agree and acknowledge that AngeLink is not responsible for the Donations raised by Campaign Organizers for Beneficiaries, nor the ultimate use of Donations by Beneficiaries. AngeLink is not a 501(c)(3) charity or nonprofit organization, creditor, agent, financial institution, or broker.

All content and information provided by AngeLink on the Platform is for informational purposes only. AngeLink does not represent, warrant or guarantee the completeness, accuracy, or reliability of any such content or information. Users should consult appropriate professionals prior to making any decisions regarding Campaigns and/or Users, including Beneficiaries, Charities, Donors or any other content or information relating to the Platform. Further, AngeLink does not have control over the conduct of any Users or any User Generated Content (defined below). AngeLink hereby disclaims, and Users hereby release AngeLink from, any and all liability and responsibility, to the fullest extent permitted by law, in any way related to: (A) conduct of any Users; (B) User Generated Content; and (C) the completeness, accuracy and/or reliability of content or information provided by AngeLink on the Platform.

Users are responsible for maintaining the confidentiality of their own password and login information and are solely responsible for all information and content posted under their account. Users agree to notify AngeLink immediately if they believe there is any unauthorized use of their account or password or if they believe there is any breach of security. Users also agree to properly sign out of their account at the end of each session when accessing the Platform. AngeLink shall not be liable whatsoever for any damage or loss that may occur from the failure to comply with the AngeLink Terms of Service information as required herein. AngeLink reserves the right to temporarily or permanently change, suspend, or discontinue the Platform (or any part thereof) at any time and for any reason with or without notice, and without any liability to you or to any third-party for any claims, damages, costs, or losses resulting from a suspension or discontinuance of the Platform.

2. NO GUARANTEE OF A SUCCESSFUL FUNDRAISING CAMPAIGN.

AngeLink does not represent, warrant or guarantee that a Campaign will obtain a certain number of Donations, or any Donations at all, and we nor do we endorse Campaigns or Users, including without limitation, Beneficiaries, Campaign Organizers, Charities and Donors. Donors are solely and exclusively responsible for determining the appropriateness of contributing to any Campaign or User, including without limitation, Beneficiaries, Campaign Organizers, Charities and Donors. AngeLink makes no representation, warranty or guarantee, express or implied, about the success of Campaigns and we expressly disclaim, and Users hereby release AngeLink from, all liability and responsibility for the subjective success or failure of Campaigns.

3. ORGANIZING A FUNDRAISING CAMPAIGN.

As a Campaign Organizer, all content and information you provide regarding your Campaign and/or the Beneficiary must be complete, accurate, and may not intentionally or negligently deceive Users on our Platform. Donations made to your Campaign must be used solely as described in the Campaign. If you withdraw Donations raised on behalf of someone else (i.e., the Beneficiary), such Donations shall be given to or used on behalf of the Beneficiary as described in the Campaign.

On AngeLink, only authorized representatives of a charitable organization may create, establish, or manage a charity fundraiser intended to benefit that organization. By creating a charity fundraiser, the organizer represents and warrants that they are duly authorized to act on behalf of the charitable organization and to solicit donations for its benefit.

If you wish to support a charitable organization and do not see an existing charity fundraiser for that organization on AngeLink, please contact the organization directly and encourage an authorized representative to establish a charity fundraiser through AngeLink. The authorized representative must provide the organization’s authorized bank account information and any other required information so that donations may be received directly by the organization. Once the charity fundraiser has been established, you may support the organization by making a donation, sharing the fundraiser with friends, family, and others, helping raise awareness of the organization’s fundraising efforts, and organizing a team of supporters to promote the fundraiser and encourage donations to the charitable organization through its official AngeLink charity fundraiser.

All payouts from charity fundraisers may be made only to a bank account connected to the fundraiser by a duly authorized representative of the beneficiary charitable organization. Under no circumstances will charity fundraiser proceeds be paid to a personal bank account or to any account that has not been authorized and verified by the charitable organization.

As a condition of creating, establishing, or managing a charity fundraiser on AngeLink, the fundraiser organizer must provide documentation from the charitable organization verifying that the organizer is authorized to act on the organization’s behalf and to solicit donations for its benefit. The organizer must also provide documentation sufficient to verify the charitable organization’s legal status, including, where applicable, proof of recognition as a Section 501(c)(3) organization under the Internal Revenue Code, evidence of tax-exempt status, the organization’s Employer Identification Number (EIN), and any other information or documentation reasonably requested by AngeLink for verification, compliance, or due diligence purposes.

AngeLink reserves the right to suspend, remove, refuse, restrict, or terminate any charity fundraiser if adequate proof of authorization is not provided, if the charitable organization’s tax-exempt or legal status cannot be verified, if the designated payout account cannot be verified as belonging to or authorized by the charitable organization, or if AngeLink determines, in its sole discretion, that the fundraiser does not comply with these Terms or applicable law.

When you raise funds for a Charity, all Donations shall be used solely for the Charity and/or the intended Nonprofit Beneficiary. The Charity must have a valid tax-exempt status under applicable law, including as an IRS tax-exempt organization, and be properly registered with the IRS and as otherwise required by federal and state law.

Campaign Organizers will be required to register and/or log in to the Platform to access certain features and functionality. By registering and/or logging in to the Platform, you expressly agree to provide complete, accurate, and timely content and information about your Campaign and the Charity. All Campaign Organizers must register on the Platform using their true identities (or the identities of the Charities’ authorized representative(s)), including their name, address, image or video of the Campaign Organizer, Charity, or the Beneficiary of the campaign. You also agree to keep all registration information up to date and current at all times.

AngeLink may use third-party data services to maintain its database of United States-based 501(c)(3) and (c)(4) charities (“AngeLink’s Search Database”), and these third parties may have the authority to enforce the provisions of the Terms of Service as it relates to third-party data. You acknowledge and agree that AngeLink may share information provided by you to these third parties so that they may enforce their rights regarding your use of their data.

If you as an authorized representative of a Charity prefer to have your Charity removed from AngeLink’s Search Database, please contact AngeLink at legal@angelink.com and provide the name of your Charity, your name, address, title, email, and phone number. Please further note that if your Charity is removed from AngeLink’s Search Database, it will not be able to receive Donations on the AngeLink Platform. All Campaign Organizers are solely responsible for compliance with all applicable laws and policies in relation to their Campaigns. All Users also solely responsible for all User Generated Content (defined below) posted, uploaded, displayed, described, or published in any manner on our Platform. Users agree to cooperate with any request AngeLink may make for evidence that we believe is necessary to verify your compliance with our Terms of Service.

There are no Platform fees to establish a Campaign. However, standard payment processing fees apply (“Payment Processor Fees”). To learn more about applicable payment processor fees see the PAYMENT PROCESSING section below.

Organization Verification, Fund Withdrawals, and Beneficial Ownership

To protect donors, beneficiaries, and the integrity of the AngeLink platform, AngeLink may require documentation and information sufficient to verify the identity, authority, legal status, ownership, management, and banking information of any organization, nonprofit, charity, business, or other entity receiving funds through the platform. Required documentation may include:

– Organization’s governmental registration, formation documents, Articles of Incorporation, or similar organizational records;
– Organization’s taxpayer identification number, including its EIN or other applicable tax identification number;
– Documentation evidencing the organization’s tax-exempt status, including proof of recognition under Section 501(c)(3) of the Internal Revenue Code, where applicable;
– Organization bank account information and bank statements;
– Government-issued identification of any individual authorized to establish, manage, administer, or withdraw funds from a fundraiser;
– Documentation establishing an individual’s authority to act on behalf of the organization, including evidence of employment, appointment, officer status, title, or other authorization;
– Information regarding the organization’s Control Officers, Beneficial Owners, directors, trustees, executives, managers, or other persons exercising substantial control over the organization; and
– Any additional documentation or information requested by AngeLink for verification, compliance, risk management, anti-fraud, anti-money laundering, know-your-customer, payment processing, or legal purposes.

All fundraisers established on AngeLink must comply with these Terms of Service and all information provided by organizers, beneficiaries, organizations, and authorized representatives must be complete, accurate, current, lawful, and truthful at all times. Organizers and organizations are solely responsible for maintaining the accuracy of all information submitted to AngeLink and must promptly update any information that becomes inaccurate, incomplete, misleading, or outdated.

All withdrawals and payouts intended for an organization, business, or other entity must be directed to a verified bank account owned by, registered to, or otherwise authorized by the beneficiary organization. AngeLink may require verification that the account belongs to or is controlled by the beneficiary organization before any payout is released.

AngeLink is not responsible for independently investigating, auditing, verifying, monitoring, or guaranteeing the identity, authority, title, beneficial ownership, control structure, governance, legal status, tax status, financial condition, legitimacy, conduct, or representations of any fundraiser organizer, organization, nonprofit, charity, business, beneficiary, Control Officer, Beneficial Owner, employee, volunteer, director, trustee, officer, agent, or representative. To the maximum extent permitted by law, AngeLink expressly disclaims and shall have no liability for any losses, damages, claims, disputes, misrepresentations, fraudulent activities, unauthorized actions, ownership disputes, beneficial ownership disputes, governance disputes, misuse of funds, diversion of funds, or other issues arising from or relating to the identity, authority, ownership, management, or control of any organization or fundraiser.

By creating, managing, participating in, or donating to an AngeLink fundraiser, organizers, beneficiaries, and donors acknowledge that AngeLink relies upon information provided by users and third parties and does not guarantee the accuracy, completeness, legality, authority, or legitimacy of any fundraiser, organization, beneficiary, or representative. Any person creating or managing a fundraiser represents and warrants that they possess all rights, authority, approvals, permissions, and authorizations necessary to establish and operate the fundraiser and to receive, direct, or administer any funds raised.

AngeLink reserves the right, at any time and in its sole discretion, to suspend, delay, restrict, reverse, refuse, hold, investigate, freeze, return, or withhold donations, payouts, or fundraising privileges, and to remove or terminate any fundraiser, account, organization, beneficiary, or user if AngeLink suspects fraud, misrepresentation, unauthorized activity, inaccurate information, ownership disputes, beneficial ownership disputes, violations of these Terms, legal or regulatory concerns, or any activity that may expose AngeLink, its users, payment processors, or donors to risk.

4. BACKGROUND CHECKS.

AngeLink reserves the right, in its sole discretion, to request or require a background check on any Campaign Organizer and/or Beneficiary as part of our risk review and verification processes. This may occur at any time, including prior to or following the withdrawal of funds, where AngeLink determines or suspects that a fundraiser may be inaccurate, misleading, incomplete, potentially fraudulent, or otherwise presents a risk of deception or harm to users or the platform.

All background checks are conducted exclusively by third-party service providers. AngeLink is not a consumer reporting agency, background check provider, or investigative agency, and does not perform background checks directly. AngeLink does not control the methodologies, databases, or processes used by such providers, nor does it guarantee the accuracy, completeness, or timeliness of any background check results.

AngeLink does not access, review, or retain underlying personal information used in third-party background checks, except as permitted by applicable law and as necessary to confirm completion or outcome status.

In addition to background checks, AngeLink may request additional information or verification from Campaign Organizers and/or Beneficiaries at any time to support platform safety, trust, and compliance. AngeLink does not guarantee the accuracy, completeness, or reliability of any information provided through these processes.

If a Campaign Organizer and/or Beneficiary is informed that a background check did not meet applicable requirements or risk thresholds, they are responsible for addressing any disputes or corrections directly with the third-party provider, in accordance with applicable law, including the Fair Credit Reporting Act (FCRA), where applicable. AngeLink does not control and is not responsible for the results or dispute processes of third-party providers.

AngeLink reserves the right to take any action it deems appropriate based on background check results or any related verification process, including but not limited to restricting, suspending, or terminating fundraisers or accounts, or limiting access to funds.

4.1 LIMITATIONS OF BACKGROUND CHECKS.

Background checks are not automatically performed on Campaign Organizers or Beneficiaries. If AngeLink determines, in its sole discretion, that a background check is necessary, Campaign Organizers and/or Beneficiaries may be required to complete such a check prior to the release of funds.

By accessing or using the AngeLink platform as a Campaign Organizer or Beneficiary, you expressly acknowledge and agree to AngeLink’s Background Check Policy and are hereby informed that AngeLink may, at its sole discretion, require a background check in connection with your fundraiser. You understand and agree that this policy may be applied without additional notice or separate consent at the time of request, and that your use of the platform constitutes acceptance of this policy.

Background checks rely on information provided by the individual, such as name, address, date of birth, or Social Security number. If inaccurate, incomplete, or misleading information is provided, results may be unreliable or incorrect. In addition, some records may be delayed, incomplete, or affected by human or system error, which may impact accuracy.

Background checks may identify potential risk indicators but are not a guarantee of legitimacy, trustworthiness, or proper use of funds. Donors should not rely solely on background check results when evaluating a fundraiser. AngeLink makes no representations or warranties regarding the accuracy or reliability of any background check or any conclusions drawn from it.

Donors are strongly encouraged to conduct their own independent research and due diligence before donating. Background checks, where performed, are only one factor among many that may be used to assess risk and should not be considered a comprehensive verification of any fundraiser.

To the fullest extent permitted by law, AngeLink disclaims all liability for any errors, omissions, inaccuracies, or outcomes related to background checks, including any losses or damages arising from reliance on such results or the absence thereof.

5. DONATIONS.

When you make a Donation, it is your responsibility to review and understand how your money will be used. You expressly acknowledge and agree that AngeLink is not responsible for any representations, warranties, guarantees, offers or promotions that may be made by Users or Campaigns. AngeLink does not verify User Generated Content, nor do we represent, warrant or guarantee that the Donations will be used in accordance with the purpose described by a Campaign Organizer or in a Campaign.

Donors can choose to opt out of publicly displaying their Donation by checking the “hide” button during the Donation process. Please be advised that your Donation information may be publicly available without your knowledge if search engines search and index Donor information. All Donors should consider if they want their Donation information anonymous or public. To learn more about how we use, collect, and store information, please see the AngeLink Privacy Policy.

Donors are not able to impose restrictions on the use of their Donations to Charitable Organizations or Nonprofits, and Charities and Nonprofits shall have sole discretion to determine how all Donations are used for charitable purposes.

Donors are required to provide their credit card or other form of payment that will be linked to their account. Donors expressly agree and warrant that their information is correct and true and that they are fully authorized to use this payment information. By donating to a Campaign, Donors understand and agree that Donations are generally not refundable, except for in special circumstances. For more information on AngeLink’s refund policy and eligibility, see the REFUNDS section below.

5.1 TAXES.

Your Donation and any Payment Processor Fees may not be tax deductible or eligible for a tax credit. AngeLink has no liability for any claim by any local, state, federal, or any other tax authority with respect to the characterization on any applicable tax return of any Donation on our Platform. All Users should consult their tax advisor(s) regarding the tax deductibility and tax treatment of Donations.

AngeLink is not responsible, and nor shall be liable, for any Charities’ use of any Donor information. Donors must provide AngeLink with such information as is required to enable the issuance of a Donation receipt. Donors expressly agree and acknowledge that their personal information may be shared with Charities and may be used by Charities pursuant to the Charities’ own policies. Donors thus may wish to review the policies from such Charities. Donors making Donations to Charities should review any state non-profit disclosures that may be applicable or require written disclosures when soliciting public contributions to Charities.

For all potential local, state or federal taxes, it is your responsibility to determine if any taxes apply to Donations, and it is your sole responsibility to collect, report, or remit the proper tax if any is due to a tax authority. This is not the responsibility of AngeLink.

You represent you are not providing any goods or services in exchange for donations. AngeLink will not provide you with any tax documentation for money raised on your fundraiser, nor will it report the funds you collected as earned income.

Donations made through personal fundraisers on AngeLink are generally considered personal gifts to the beneficiary and are not intended to be treated as payment for goods or services. Such donations are typically not tax-deductible for donors. However, in certain circumstances, amounts received through a fundraiser may be considered taxable income to the recipient depending on the specific facts and applicable tax laws.

Organizers and beneficiaries are solely responsible for maintaining accurate records of all donations received and for determining and fulfilling any tax reporting obligations. AngeLink does not provide tax advice, and users are encouraged to consult with a qualified tax professional or advisor regarding their individual tax obligations.

As part of these Terms, fundraiser organizers represent and warrant that they are not providing goods or services in exchange for donations received through the platform.

Please note that any Form 1099-K or other applicable tax reporting form may be issued directly by AngeLink’s third-party payment processor, and not by AngeLink itself. AngeLink does not issue tax forms directly and has no control over, and disclaims any responsibility for, the policies, reporting thresholds, classifications, or determinations made by its third-party payment processors.

The issuance of a Form 1099-K by the payment processor is subject to applicable laws and the processor’s own policies, which may include reporting thresholds such as exceeding $20,000 in gross payments and/or more than 200 transactions within a calendar year, or such other thresholds as may apply under federal or state law or processor requirements.

Amounts reported on a Form 1099-K associated with activity on the platform may include both taxable and non-taxable amounts depending on the nature of the fundraiser and underlying transactions. Receipt of a Form 1099-K does not determine tax liability. AngeLink does not provide CPA, tax, or accounting advice, and you should consult with your own qualified CPA or tax advisor to obtain individualized tax guidance regarding your specific situation.

For verified charitable organizations recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, donors may receive a donation receipt directly from the charitable organization. Such receipts may be used by donors to determine whether a contribution is tax-deductible under applicable law. Tax deductibility is not guaranteed and is subject to the donor’s individual circumstances and applicable tax regulations.

AngeLink has no control over the form, content, accuracy, or tax treatment of any receipt issued directly by a charitable organization using the AngeLink platform. Tax-exempt status applies solely to the charitable organization issuing the receipt and does not apply to AngeLink itself.

5.2 PAYMENT PROCESSING.

Payment processing services for users on AngeLink are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these terms or continuing to operate as a user on AngeLink, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of AngeLink enabling payment processing services through Stripe, you agree to provide AngeLink accurate and complete information about you and your business, and you authorize AngeLink to share it and transaction information related to your use of the payment processing services provided by Stripe.

Users agree to the terms of all AngeLink third-party payment processors and other service providers required to provide Users access to and use of the Platform. If AngeLink or a payment processor finds that a User provided false, incorrect information, or information that violates these Terms of Service or the terms of service of our third-party service providers, AngeLink reserves the right to immediately terminate and/or suspend such User’s account and/or Campaign. Any fine levied by state, local, or federal authorities as a result of a User violating these Terms of Service or the terms of service of our third-party service providers must be paid solely by such User. AngeLink reserves the right to exchange information with our third-party service providers as required and pursuant to the AngeLink Privacy Policy.

AngeLink uses third-party transaction processing and payment processing partners to bill Donors using the payment information provided. Donors acknowledge and fully agree that by making a Donation to a Campaign or Charity, you are agreeing to all the applicable terms of all AngeLink third-party payment processing and transaction processing vendors. Users are subject to the payment processor’s terms and conditions. AngeLink is not a payment processor and does not hold funds. AngeLink does not withhold funds for tax purposes or otherwise. Charities are solely responsible for taxes based on applicable federal, state, local applicable taxes based on their net income and gross receipts.

AngeLink reserves the right to suspend, reverse, or refuse any User transactions or Donations that we believe (in our sole and exclusive discretion) may harm the interests of our Users, vendors, payment processors or the public for any reason, or that may expose a User or AngeLink to any liability or risk.

5.3 ACCOUNT HOLDS.

AngeLink reserves the right, in its sole and exclusive discretion, to suspend or put a hold on a Campaign account, restrict any withdrawals (“Withdrawals”), secure a reserve, or reverse an ACH transfer or other form of payment or transfer of funds for any reason to protect Users and/or the Platform. AngeLink reserves the right to do this if we believe, in our sole and exclusive discretion, that information provided by a Campaign Organizer is misleading, inaccurate, false, or fraudulent. We expressly prohibit the collection of funds that are being used in an inappropriate, unethical, or illegal manner, for example:

5.3.1 If Campaign funds are directly transmitted to the Beneficiary or person entitled by law to act on behalf of a Campaign Organizer rather than the Campaign Organizer itself.

5.3.2 If AngeLink believes, in our sole and exclusive discretion, that a Campaign Organizer, Beneficiary or a Campaign has violated these Terms of Service for any reason or that AngeLink believes that the Campaign Organizer is defrauding Donors or engaging in illicit or inappropriate or unethical activity of any kind.

5.3.3 If AngeLink believes, in our sole and exclusive discretion, that there is erroneous, fraudulent, or suspicious donation activity and/or we are required by law enforcement or court order, subpoena, injunction, or writ under applicable law or regulation to report the activity.

This is in no way an exclusive list. For further information or questions on an account hold or additional information on how to resolve an issue with an account hold, please contact the AngeLink Legal Team at legal@angelink.com.

5.4 WITHDRAWALS.

AngeLink strives to make Withdrawals on a timely basis. However, such Withdrawals may not be available immediately, as AngeLink does not warrant or guarantee that Withdrawals will be available to you within any specific time frame.

AngeLink fully disclaims any and all responsibility for a delay of a User Withdrawal or any other reason that you may be unable to access and use Withdrawals promptly. AngeLink also cannot be responsible for enabling Withdraws for a specified time period or for any issue that may arise from a delay or inability to process a Withdrawal. All Campaign Organizers are each fully responsible for providing accurate and complete information for AngeLink to properly process a Withdrawal, including all proper bank account information.

See AngeLink’s Withdrawal FAQs for more information.

Further, you acknowledge and agree that Fundraiser organizers must provide all required documentation and banking information needed to connect their bank account and receive funds within 90 days of the fundraiser creation date. If the organizer fails to do so within that timeframe, AngeLink reserves the right to refund all donations to the donors’ original form of payment. Organizers are responsible for ensuring all required information is submitted accurately and on time in order to receive funds from their fundraiser.

See AngeLink’s Refund Policy for more information.

5.5 Other Payment Policies

Organizer, Beneficiary, and Fund Usage Restrictions

On AngeLink, a fundraiser organizer may only create or manage a fundraiser in accordance with AngeLink’s Terms of Service and must clearly identify the intended beneficiary of all funds raised.

In cases where the organizer is also the beneficiary, the organizer may receive funds directly into a verified bank account registered in their name, subject to identity verification and compliance requirements. Where the organizer is not the beneficiary, all funds must be directed solely to the verified beneficiary or an authorized representative of the beneficiary organization. Organizers may not receive, hold, or redirect funds on behalf of another individual or organization unless expressly authorized and verified through AngeLink’s verification process.

Organizers may make voluntary contributions to their own fundraisers; however, such activity may be monitored and reviewed for fraud prevention, compliance, and anti-money laundering purposes, and may be restricted at AngeLink’s sole discretion.

Fundraisers must not be used as a means to facilitate cash advances, credit extensions, circular funding arrangements, or any similar financial arrangements that are not genuine fundraising activity. AngeLink reserves the right to suspend, restrict, investigate, delay, hold, or remove any fundraiser or account where it determines, in its sole discretion, that the fundraiser is misused, misleading, non-compliant, or inconsistent with the intended purpose of the platform.

Organizer, Beneficiary, and Payment Responsibility

On AngeLink, fundraiser organizers are solely responsible for ensuring that all beneficiary information, banking details, and payout instructions provided in connection with a fundraiser are accurate, complete, current, and properly authorized. Organizers represent and warrant that they have all necessary rights, permissions, and authority to collect, manage, and direct funds as described in their fundraiser.

Where an organizer creates or manages a fundraiser on behalf of another individual or entity, the organizer assumes full responsibility for the collection, handling, transfer, and use of any funds received, including any decision to receive funds into their own bank account prior to disbursement to the intended beneficiary. AngeLink does not control, supervise, direct, or guarantee the manner in which an organizer handles, stores, or transfers funds after receipt.

AngeLink is not responsible or liable for any disputes, disagreements, claims, losses, chargebacks, reversals, or legal actions arising between an organizer and a beneficiary, including but not limited to disputes regarding access to funds, timing or method of transfer, allocation of funds, or whether funds were properly delivered or used by the intended beneficiary.

AngeLink is also not responsible or liable for any failure by an organizer to correctly connect, verify, maintain, or update a beneficiary’s bank account or payment information, nor for any delays, rejections, holds, freezes, or failures resulting from incorrect, incomplete, outdated, or unauthorized banking information provided by users or third parties.

All parties acknowledge and agree that AngeLink serves solely as a neutral technology platform facilitating fundraising transactions and does not act as an agent, fiduciary, trustee, financial institution, money transmitter, or guarantor for any organizer, beneficiary, or donor. Use of the platform does not create any partnership, joint venture, fiduciary, or employment relationship between AngeLink and any user.

AngeLink reserves the right, at any time and in its sole discretion, to monitor, investigate, verify, suspend, delay, hold, reverse, refund, restrict, or terminate any fundraiser, transaction, or account where required for compliance, legal obligations, fraud prevention, risk management, or platform integrity purposes, including where AngeLink reasonably suspects misuse, misrepresentation, unauthorized activity, or violation of these Terms.

6. USER GENERATED CONTENT.

When you post text, descriptions, videos, data, images and photos, GIFs, trademarks, comments, content and other information (“User Generated Content”) on the AngeLink Platform, it is available to the public. User Generated Content may be shared with other Users and may be displayed on the AngeLink Platform, including any Campaign Organizer or Beneficiary’s personal information in the Campaign description.

AngeLink collects information from communications with Users as well as User questions, comments, and ideas for Platform enhancements, product modifications, customer reviews, testimonials, customer support interactions or suggestions. By sending AngeLink these types of unsolicited requests, suggestions or information (“Unsolicited Material”), you agree that AngeLink is not bound by any confidentiality obligations, expressed or implied, with respect to this Unsolicited Material. You also acknowledge that AngeLink may have similar product ideas, modifications, and/or enhancements under consideration or potentially in development. You agree that AngeLink has unrestricted use and ability to disseminate all Unsolicited Material for any purpose whatsoever without acknowledgment or compensation to any User. If you choose to submit Unsolicited Material, you hereby grant to AngeLink an irrevocable, non-exclusive, royalty-free, perpetual, worldwide, fully transferable license to use, reproduce, display, distribute, modify, create derivative works of, and commercially utilize any and all Unsolicited Material. You also irrevocably waive, and cause to be waived, against AngeLink and its Users any claims and assertions of any moral rights contained in such Unsolicited Material on our Platform and all rights as stated herein shall survive any termination of your account or the Platform.

AngeLink reserves the right to maintain any Unsolicited Material, as well as User Generated Content, and may disclose this information if required by law or if we believe that we may need to maintain this information to comply with applicable laws or government regulations; to protect the property, rights, or safety and security of AngeLink, our Users, or others; or to enforce these Terms of Service.

You represent, warrant and guarantee that you own all right, title and interest and/or proper consents to your User Generated Content as well as all trademarks, service marks, and rights of publicity/privacy relating to the same. You hereby expressly grant AngeLink and Users the worldwide, nonexclusive, royalty free, transferable, perpetual, sublicensable and irrevocable license to copy, upload display, modify and store your User Generated Content pursuant to your Campaign or Donation for the potential advertising, promotion, marketing of any kind. If your User Generated Content includes your photo, name, or image, you hereby expressly release and hold harmless AngeLink, our designees, third-party partners, and our employees from any and all claims such as (but not limited to) libel, publicity or invasion of privacy, as well as liability for other claims if any image is distorted or altered for any reason.

You also hereby expressly release and hold harmless AngeLink, our designees or affiliates, third-party partners, and our employees from any and all claims relating to marketing, exposure or exploitation of your image, photo, name, information, as well as all User Generated Content for any liability for claims made by you, or any successor to any claim. You hereby waive any right to approve or inspect any information or content that may be generated by AngeLink, our assigns, or our designees for any reason.

If any other person or entity other than you as the rightful Campaign Organizer appears in your User Generated Content, you represent, warrant and guarantee that you have secured all necessary rights, permissions, waivers, releases and/or licenses from such person(s) and/or entity(ies) for the benefit of AngeLink required and as set forth in our Terms of Service. You acknowledge and agree that you will not receive any financial compensation for any reason whatsoever associated with such User Generated Content rights, waivers, licenses, and releases as set forth herein and that the only consideration you will receive is the opportunity to access the Platform. User Generated Content may not appear on the Platform as we reserve the right (but not the obligation) to edit, modify, suspend, or remove any User Generated Content. We reserve these rights at our sole and exclusive discretion and without notice to you for any reason that may include receipt of claims, allegations, and request for information from authorities relating to such User Generated Content. If we believe, in our sole and exclusive discretion, that you may have violated any provisions of these Terms of Service, we reserve the right to suspend, hold, block, or remove any User Generated Content from the Platform.

6.1 THIRD-PARTY CONTENT AND/OR SERVICES.

AngeLink is not liable for any materials, information, or content of a third-party or User Generated Content and is not limited by any reason, error, or omission in any circumstance. Any arbitration between you and AngeLink shall be settled under the Federal Arbitration Act and administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules as outlined in these Terms of Service. You may obtain the AAA filing forms by contacting AAA directly.

If a party intends to seek arbitration you must send a written notice of the dispute to the other party by Express Mail with signature required or by certified Mail or if the other party has not provided a current physical address, then by email. The Notice of Arbitration must describe the basis of the dispute or claim and set forth the demand for relief sought. In that case, you agree to reimburse us for all monies previously disbursed by AngeLink that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits.

Date of Last Revision: October 22, 2025

This AngeLink, Inc. (“AngeLink”) Privacy Policy (the “Privacy Policy” or “Policy”) describes and governs how we collect, use, store and share user information that may be collected on the AngeLink platform.

All users should review this Policy carefully prior to using the AngeLink platform. The English version of this Policy is binding, and other translations are for convenience only. If you are a California resident, you may be protected by additional rights that may be found in the California Consumer Privacy Act of 2018 Notice. AngeLink Inc. is the data controller and can be reached by contacting AngeLink. You do not need to consent to this Privacy Policy but do acknowledge you have read and understood these Privacy Policy terms. We may notify you of changes to this Privacy Policy by updating the date on this policy and by sending you an email.

AngeLink uses the information collected on our platform and through our services per the terms of this Policy. AngeLink may use the information we collect to contact users to provide services and information that you request, as well as to respond to questions or comments that users may have. We may also use this information to send updates, communications, promotions, and information relating to our services. We may also send periodic emails to users relating to usage and interactions on our platform.

1. INFORMATION COLLECTED.

When you register for AngeLink services or open an account, we collect contact information, login details, photo or video, zip code, country, and other additional information you provide. Charities and nonprofit organizations register accounts with contact information, name, address, tax ID, photos, videos, logo, phone number, as well as other information that may be provided to third-party data services or charitable rating service providers for this purpose. You can edit your information by logging into your AngeLink account at any time. If you have any questions or want to review the information, please send an email to legal@angelink.com.

When you create an AngeLink campaign we may collect information such as a campaign title, campaign category, funding goal, description, photos, videos and other information you provide. Our payment processor partners collect and maintain information related to the withdrawal of funds for each campaign. When you donate to a campaign, we may collect your contact information such as name, phone, address, email address, zip code, country, and any other information you provide. Our payment processor partners collect your credit card details and other required information to process your donation.

AngeLink users can leave feedback, comments, thank-you notes, and other related messages for other platform users. All of this content may be available to the public by default. AngeLink welcomes your questions and feedback. We would love to hear from you about any new product suggestions, modifications, and ideas at any time. When you do this, we may collect information you provide such as your contact information, message, suggestions as well as any documents you send to us. Any of this information you may provide may be shared and may become public information for all our users to share their opinions.

When you use AngeLink services to create a fundraising campaign, you provide information such as your city, state, and zip code. All AngeLink users may be able to view the information you provided when they view your campaign on the AngeLink platform. AngeLink may also use your location information as described herein.

AngeLink may provide a non-profit organization or charity the ability to conduct an event or promotion and when doing so we may collect your contact information, including name and address, in order to properly administer and fulfill awards and prizes, if applicable. We may also collect your information to inform you of relevant announcements, upcoming events, and promotions.

2. USE OF INFORMATION.

Information that we collect is used to operate our platform and provide our services, customer support, and reporting functions. We may also use this information for analytics and product development purposes such as preferences and usage trends, in order to improve usability and security on our system and platform. AngeLink may use user information to determine how users interact with our platform to customize and personalize our content, including the language and campaigns on AngeLink homepages based on user location. AngeLink may require this information for our legitimate interest in providing services to AngeLink users. AngeLink also uses information collected in order to comply with state, local, federal, and/or international laws, defend AngeLink legal rights, as well as to enforce our Terms of Service and Privacy Policy.

How do we transmit data from the user’s device?

We get some data from user’s device with permission, including:

  • 1. Images for profile image and fundraiser’s cover photo (both storage and camera)
  • 2. Contacts list for inviting a new team member
  • 3. Download receipts to device’s storage
  • 4. User’s location to show nearest fundraisers
3. BACKGROUND CHECK INFORMATION.

On the AngeLink Platform, background checks are not automatically performed on Campaign Organizers and/or Beneficiaries. If AngeLink, in its sole discretion, believes that a fundraiser may be misleading, fraudulent or inaccurate for any reason, or that the Campaign Organizer may potentially deceive Donors, AngeLink may require that a third-party background check be conducted on the Campaign Organizers and/or the Beneficiaries prior to the withdrawal of funds. Depending on the outcome of this third-party background check, AngeLink reserves the sole and exclusive right to conduct further investigations on the Fundraiser, Campaign Organizer and/or Beneficiary as may be deemed necessary, in AngeLink’s sole discretion. AngeLink is not a background check company and does not perform background checks. Thus, AngeLink uses a third-party background check vendor to perform these background checks. Campaign Organizers and Beneficiaries who are requested by AngeLink to complete a background check will receive communications from the third-party background check vendor requesting them to complete and submit an authorization for such background check. AngeLink does not process or store background check reports and does not control how the background check information is used by these third parties. However, the third-party background check vendor will notify AngeLink if the Campaign Organizer and/or Beneficiary passes or fails the background check based on relevant factors as determined by AngeLink. By completing a background check, Campaign Organizers and Beneficiaries agree to the third-party background check vendor’s terms of use. Background checks are conducted in an effort to help verify the Campaign Organizer and/or the Beneficiary in an effort to build trust among the community, however, AngeLink does not warrant or guarantee this.

If the Fundraiser and/or the Beneficiary (as applicable) is notified that he/she failed third-party background check, the Fundraiser and/or the Beneficiary will be advised that he/she may contact the third-party background check company to file a dispute and provide documents to remedy any inaccuracies in the background check, per the Fair Credit Reporting Act.

It is important to note that background checks can vary in comprehensiveness according to variations among federal, state, county and/or local databases and availability of criminal history and information. Additional limitations may apply in certain jurisdictions as well. Background checks are performed only with the consent of the person about whom the background check is being performed, using information that is provided by the subject of the background check, such as name, home address, date of birth and social security number. If incorrect information is provided by the subject of the background check, the results of the background check may be inaccurate or have incorrect identifying data, which may impact the results of the background check. Additionally, some databases and/or criminal records may not be reported promptly or accurately, or due to electronic or human error, results may be incomplete or inaccurate. Background checks may be helpful to uncover potential red flags, however, Donors should not solely rely upon background checks to ensure the validity of a Campaign. AngeLink recommends that background checks be performed as only one portion of a Donor’s review of a Campaign worthiness.

4. SHARING OF INFORMATION.

AngeLink may share information we collect on our platform with certain third parties without notice to users. AngeLink may hire third-party companies to perform business projects and we may provide access to or share user information with such third-party companies for them to complete work on AngeLink’s behalf. AngeLink requires all third parties to maintain the confidentiality of AngeLink information.

We provide user information to other users of the AngeLink platform if you make your information publicly available in a publicly accessible area of our platform. Some information users provide in forums, comments, and customer support communications may be publicly accessible.

If AngeLink engages in the purchase or sale of another business or asset such as a merger, reorganization, dissolution, etc., which may include the exchange of due diligence information, user information may be part of the transferred assets. AngeLink has the right to disclose, transfer, and access user information when we have a legitimate belief that it is necessary to comply with state, local, or federal laws, including but not limited to court orders, subpoenas, search warrants, or other legal processes. AngeLink responds to inquiries or requests from law enforcement, government, regulatory authorities, or data protection organizations to protect and defend the legal rights, privacy, safety, or property of AngeLink employees, affiliates, subsidiaries, or agents. We may also do so for our users and to permit us to pursue remedies or participate in or defend against litigation or to limit any damages we may sustain, or to enforce this Privacy Policy or any applicable Terms of Service.

AngeLink shares user information with campaign organizers and campaign beneficiaries. We may share the user’s name, email address, and other information provided in connection with a donation to the fundraiser and campaign beneficiary. AngeLink users acknowledge and agree that campaign beneficiaries may communicate with you about your donation and may require user information to comply with reporting and legal requirements. AngeLink may share user information when you consent to the sharing of your information to arrange for specific campaigns with third-party organizations. If you consent to delivering your contact information to a specific partner, we share, with the partner organization, your name, address, email, and other information with your donation to a specific campaign. When you register for an event on the AngeLink platform, we share your information with individuals who are organizing the event.

AngeLink may conduct research on our customer comments, interests, demographics, and behaviors based on collected information. We may collect this information for research purposes as well as other purposes (e.g., to improve the AngeLink services), and we can share this information with our agents, affiliates, business partners and other third parties.

6. THIRD-PARTY INFORMATION.

You may provide AngeLink with third-party information when you share your campaign with friends and family. When doing so, we may request access to information stored in your email or on your mobile device address books, such as emails, phone numbers, names, etc. and third-party data (“Third-Party Data”). When you use this type of feature that enables you to communicate with third parties by submitting Third-Party Data to the Services or permitting the Services to automatically access your Third-Party Data, you acknowledge and agree that you have the authority of the relevant third-party for AngeLink to access and use this Third-Party Data and that you have notified and informed these third parties on how their information is collected and used by AngeLink. We reserve the right to identify you as the referring person for any messages that may be sent to them. AngeLink may use Third-Party Data to contact these providers or to send a message and communicate between you and such third-party through AngeLink. We may send additional messages and reminders to third parties on your behalf as permitted under applicable law. In all cases, any such communications sent to third parties utilizing Third-Party Data will provide a way to “opt out” of receiving additional similar communications.

7. INFORMATION RETENTION.

AngeLink only retains information for as long as required and to the extent permitted by applicable laws. AngeLink will remove information from our system and records when this user data is no longer needed. We then anonymize data so that users can no longer be individually identified, in accordance with AngeLink’s corporate document retention policy. The AngeLink retention policy is based on various criteria, such as the type of products/services requested by users or provided to users, the time period as well as mandatory retention periods pursuant to state and federal law as well as statute of limitations.

8. UNSOLICITED INFORMATION SUBMITTED BY USERS.

AngeLink also collects information via our customer support pages which may include feedback, user suggestions or other unsolicited submissions. When you send us unsolicited submissions you agree and acknowledge that AngeLink is under no obligation of confidentiality with respect to your unsolicited submission. You further acknowledge and agree that AngeLink may have your unsolicited submission, idea, or product/service suggestion already under consideration or in development, and you grant AngeLink an irrevocable, non-exclusive, perpetual, royalty-free, worldwide license to use, create derivative works, modify, publish, distribute and sublicense the unsolicited submission. AngeLink Assurance

At AngeLink, we are building technology to help make fundraising safe, trustworthy, and impactful. The AngeLink Assurance reflects our commitment to supporting donors, fundraisers, beneficiaries, and our wider community.

We use advanced tools and multi-level monitoring systems to help identify potential risks and keep the platform secure. While no system can catch every issue, we review reported fundraisers carefully and do our best to ensure that campaigns operate as intended.

If a fundraiser appears inaccurate, misleading, or inconsistent with its stated purpose, our Security Team may investigate and take action as appropriate. We strive to address concerns thoughtfully, but all reviews and decisions are made at AngeLink’s discretion, and we cannot guarantee specific outcomes, including the recovery, reimbursement, or proper use of funds.

    Safety and Security

AngeLink cannot guarantee the accuracy, completeness, reliability, or legitimacy of any fundraiser, campaign organizer, beneficiary, or donation on the platform. We use proprietary systems, third-party data sources, and internal review processes to help identify and address potentially fraudulent or improper activity. These measures may include automated monitoring, manual review, and account analysis. However, no system is foolproof, and AngeLink makes no representations or warranties that fraudulent, misleading, or unlawful activity will be detected or prevented.

AngeLink reserves the right, at its sole discretion and with or without notice, to review, investigate, suspend, restrict, remove, or take any other action with respect to any fundraiser, account, content, or transaction that may violate these Terms of Service, Community Guidelines, applicable law, or that we believe may pose a risk to users, third parties, or the platform.

During any review or investigation, AngeLink may require campaign organizers, beneficiaries, or other users to provide documentation or verification materials, including identification documents, financial records, medical documentation, or other relevant records. We may also use third-party verification services, external databases, and background checks pursuant to our Terms of Service.

AngeLink is not responsible for the actions, omissions, or statements of users and does not control how funds are used after donation. To the fullest extent permitted by law, we disclaim liability for any loss, damage, or harm arising from use of the platform or reliance on fundraiser content.

If you believe a fundraiser is fraudulent or violates our policies, you should report it using the “Report this Fundraiser” feature. Reports may be reviewed at our discretion and do not guarantee any particular action or outcome.

AngeLink may cooperate with law enforcement and disclose information when required or permitted by law. Users who believe they are victims of fraud should contact their local authorities.

AngeLink is not a bank, financial institution, or payment processor. Payment services are provided by third-party providers, and AngeLink is not responsible for their actions, processes, or decisions.

For law enforcement inquiries, please contact legal@angelink.com.

At AngeLink, we are building a trusted fundraising platform designed to help people support individuals, causes, and charitable organizations worldwide. Our community is founded on integrity, honesty, and transparency. Giving to someone in need is an act of generosity and compassion, and AngeLink is committed to helping ensure that fundraising campaigns on our Platform are legitimate and compliant with our Terms of Service.

    General Refund Policy

Contributions made through the AngeLink Platform are generally provided either as personal gifts to individuals or as charitable donations to qualified 501(c)(3) organizations and are therefore generally nonrefundable. By making a donation, you acknowledge and agree that your contribution is voluntary and, except as expressly provided in this Policy, is not eligible for a refund.

A donor may submit a refund request within thirty (30) days of the donation date if the donated funds have not yet been transferred to the fundraiser organizer, beneficiary, or charity. Submission of a refund request does not guarantee approval or eligibility for a refund. All refund determinations relating to personal fundraising campaigns are made solely at AngeLink’s discretion.

For donations made to a qualified 501(c)(3) charity through the AngeLink Platform, any decision regarding a refund is made solely by the recipient charity and not by AngeLink. Donors seeking a refund for a charitable donation must contact the recipient charity directly.

Refunds, if approved, will generally be returned only to the original form of payment used for the donation and may take approximately 7–10 business days to process. If the original payment method is unavailable, closed, expired, or otherwise unable to receive a refund, AngeLink may not have the ability to process a refund and shall have no obligation to issue a refund unless otherwise required by applicable law.

By using the AngeLink Platform, you expressly acknowledge and agree that, to the extent reasonably practicable, donor refunds will be processed before funds are withdrawn from a fundraiser. You further acknowledge and agree that AngeLink’s ability to issue refunds is subject to the availability and recovery of funds, and AngeLink makes no representation, warranty, or guarantee that funds that have been withdrawn, transferred, spent, distributed, or otherwise become unavailable can be recovered or refunded.

Refunds Related to Fraud, Misrepresentation, or Policy Violations

If AngeLink determines, in its sole discretion, that a fundraiser has been misrepresented, is fraudulent, or violates our Terms of Service, AngeLink may suspend or terminate the fundraiser and may, but is not obligated to, refund donations to donors to the extent reasonably possible. Any such refund will be made only to the donor’s original form of payment. Once a refund has been initiated, it cannot be reversed.

Any determination of fraud, misuse, or misrepresentation is made solely at AngeLink’s discretion.

If funds were withdrawn from a potentially fraudulent fundraiser but are subsequently recovered by AngeLink, those recovered funds may be refunded to affected donors, to the extent reasonably possible, using the donor’s original form of payment. AngeLink does not guarantee recovery of funds once withdrawn, transferred, spent, or otherwise no longer available.

AngeLink reserves the right to investigate any fundraiser reported by users or otherwise suspected of misuse, fraud, misrepresentation, or violations of its policies at any time.

    Unclaimed or Unprocessed Fundraisers

Fundraiser organizers must provide all required documentation, identity verification, banking information, and any other information requested by AngeLink or its third-party payment processor within ninety (90) days of creating a fundraiser in order to establish a withdrawal account and receive funds.

If an organizer fails to provide the required information within the ninety (90) day period, AngeLink reserves the right to refund all donations to donors. By accessing and using the AngeLink Platform, organizers specifically acknowledge and agree that they are solely responsible for providing complete, accurate, and timely information necessary to receive funds. Failure to do so may result in all donations being refunded to donors and the organizer forfeiting any right to receive those funds.

When a Donor May Request a Refund

A donor may submit a refund request if:

    – The donation was made to the wrong fundraiser, person, or charity
    – The donation was unauthorized
    – The donation amount exceeded what the donor intended to contribute
    – The donor reports suspected fraud relating to the fundraiser
    – The donor reports suspected misuse of donated funds
    – The donor wishes to reverse an unintended tip

Submission of a refund request does not guarantee approval. All refund decisions are made in accordance with this Policy and at AngeLink’s sole discretion.

Refund Requests by Organizers or Beneficiaries

Generally, organizers may not receive refunds for donations made to their own personal fundraiser or to a fundraiser they created for a beneficiary.

In certain circumstances, organizers or beneficiaries may determine that funds are no longer needed and may request that donations be refunded to donors. Such requests must be made before any funds are withdrawn from the fundraiser. Once a refund process has been initiated, it cannot be reversed.

    Eligibility Requirements for Refund Requests

To be considered for a refund under this Policy, you must:

    – Not have participated in, contributed to, or benefited from any misuse, fraud, or other improper activity relating to the fundraiser
    – Not have previously received a refund and subsequently filed a chargeback related to the same donation
    – Not have previously submitted a refund request relating to the same donation that has already been reviewed and resolved
    – Report suspected fraudulent activity through AngeLink’s “Report a Fundraiser” feature and allow at least five (5) business days for review
    – Provide all information, documentation, evidence, and cooperation reasonably requested by AngeLink

    Cooperation Requirements

By submitting a refund request, you agree to:

    – Notify AngeLink of any new information or communications relating to the fundraiser
    – Cooperate with any investigation conducted by AngeLink or law enforcement authorities
    – Return or repay any refund granted under this Policy if you later recover the same funds from another source

Circumstances Where Refunds Will Generally Not Be Granted

Refunds generally will not be provided if:

    – The fundraiser or donation is not covered by this Policy
    – The donation was made to a charity or nonprofit organization, except as specifically provided below
    – You simply regret making the donation
    – You have a personal disagreement with the fundraiser organizer or beneficiary
    – You disagree with how funds are used, distributed, managed, or allocated, including the use of funds exceeding a fundraising goal
    – You seek a refund for a donation made to your own fundraiser
    – You seek reimbursement for funds raised, transferred, or exchanged outside of the AngeLink Platform
    – The fundraiser was suspended, restricted, or removed for reasons unrelated to fraud, misuse, or misrepresentation
    – You disagree with AngeLink’s designation or redesignation of a beneficiary
    – You disagree with payment instructions, withdrawal decisions, or fund distribution decisions
    – Funds were withdrawn by an authorized individual, distributed pursuant to a court order, subject to garnishment, withholding, or otherwise legally redirected
    – You incurred expenses relating to a fundraiser but are not the beneficiary of the fundraiser

    Charity Donations

Donations made to qualified 501(c)(3) charitable organizations are voluntary charitable gifts and are generally nonrefundable.

By using the AngeLink Platform, you expressly acknowledge and agree that any decision regarding a refund of a charitable donation is made solely by the recipient charity and not by AngeLink.

In limited circumstances, a charity may elect to provide a refund, including where:

    – The donation was unauthorized
    – The donation was made by mistake
    – The donation amount was entered incorrectly

Donors seeking refunds for charitable donations must contact the recipient charity directly to make their refund request.

    AngeLink’s Rights and Discretion

AngeLink may establish minimum donation thresholds that must be met before a refund request will be considered.

By using the AngeLink Platform, you acknowledge and agree that all refund requests, investigations, determinations, and resolutions relating to personal fundraising campaigns are made solely at AngeLink’s discretion. AngeLink’s decisions regarding refund eligibility, investigations, misuse determinations, beneficiary designations, beneficiary redesignations, and all related matters are final, conclusive, and not subject to appeal.

If AngeLink determines that misuse, fraud, misrepresentation, or other misconduct may have occurred, AngeLink may, in its sole discretion, elect to refund donors directly rather than distribute funds to the intended recipient. To the extent reasonably practicable and subject to availability of funds, such refunds will be processed before funds are withdrawn from a fundraiser. Once a refund has been initiated, it cannot be reversed.

AngeLink reserves the right to investigate any fundraiser at any time and to suspend, restrict, terminate, remove, or take any other action with respect to any fundraiser that violates this Policy, the Terms of Service, applicable law, or that AngeLink reasonably believes may involve misuse, fraud, misrepresentation, or other misconduct.

AngeLink reserves the right to modify, suspend, replace, or terminate this Refund Policy at any time without prior notice.

This Refund Policy does not constitute a warranty, guarantee, insurance policy, or protection against fraud, misuse, loss, or any failure of a fundraiser to achieve its intended purpose. Rights under this Policy are personal to the donor and may not be transferred or assigned.

This Policy constitutes the complete understanding between you and AngeLink regarding refunds and supersedes any prior oral or written statements concerning refund eligibility. In the event of any conflict between this Policy and the AngeLink Terms of Service, the Terms of Service shall govern and control.

Any refund granted by AngeLink or a charity in a particular circumstance shall not create any obligation, precedent, or expectation that a refund will be granted in any future circumstance.

To the maximum extent permitted by law, AngeLink shall not be liable for any losses, damages, costs, expenses, claims, liabilities, or causes of action arising out of or relating to any donation, fundraiser, refund request, refund denial, refund approval, fundraiser suspension, fundraiser removal, beneficiary designation, beneficiary redesignation, investigation, or any decision made under this Refund Policy.
